1. Acceptance of Terms
By accessing or using Training Hub 365 (the "Service") operated by Faithful Supply LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Training Hub 365 is a cloud-based employee training compliance management platform. The Service enables organizations to manage employee training requirements, schedule training events, capture digital sign-offs, track certifications, and maintain a training compliance matrix.
3. Account and Access
Access to the Service requires a Microsoft work account (Azure Active Directory). You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Upload malicious code, viruses, or harmful content
- Reverse engineer, decompile, or disassemble the Service
- Resell or redistribute the Service without authorization
5. Data Ownership and Responsibility
You retain full ownership of all data you enter into the Service, including employee information, training records, and compliance documentation. You are responsible for the accuracy and legality of the data you provide. We act as a data processor on your behalf.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.
7. Intellectual Property
The Service, including its design, code, features, and documentation, is the intellectual property of Faithful Supply LLC. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
8. Payment and Billing
Paid plans are billed through the Microsoft commercial marketplace. Pricing, billing cycles, and payment terms are as described on the marketplace listing. Free tier usage is subject to the limits described on our pricing page.
9. Termination
Either party may terminate this agreement at any time. You may stop using the Service and cancel your subscription through the Microsoft marketplace. We may suspend or terminate access if you violate these Terms. Upon termination, we will make your data available for export for 30 days, after which it may be deleted.
10. Limitation of Liability
To the maximum extent permitted by law, Faithful Supply LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Texas.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
